To be part of the Reduce & Reward Powerpal Program (“Powerpal Program”) you need to agree to these terms and conditions. These terms and conditions are between IPower Pty Ltd (ACN 111 267 228) and IPower 2 Pty Limited (ABN 24 070 374 293) trading as Simply Energy (ABN 67 269 241 237) (referred to as ‘we’, ‘us’ or ‘our’) and you.

1. Participation

1.1.    To participate in this Powerpal Program you need to:
(a)    be a non-solar Simply Energy residential customer in Victoria and have been a billable customer for at least 2 months;
(b)    have a smart meter;
(c)    register for the Powerpal Program via www.simplyenergy.com.au/powerpal
(d)    Be one of the first 400 customers to successfully register at www.simplyenergy.com.au/powerpal for the Powerpal Program, or have an existing Powerpal energy monitoring device (Powerpal Device)
(e)    install the Powerpal Device at your home and agree to the relevant terms as set out here: https://www.powerpal.net/terms-and-conditions;
(f)    grant us access to and use of the energy data from your Powerpal Device as set out in our Privacy Policy here: https://www.simplyenergy.com.au/help-centre/policies-and-commitments/privacy-policy; and
(g)    not be or live with someone where turning off certain appliances would be harmful; including but not limited to someone who has life support equipment, someone with a physical underlying medical condition which may be impacted by turning off appliances or someone who may be adversely affected by reducing their electricity usage.

2. Reward

2.1.    If you participate in the Powerpal Program, you may be invited by us to:
(a)    receive a Powerpal Device free of charge, and ownership will transfer to you upon receipt of the Powerpal Device;
(b)    reduce your energy usage during a peak demand event;
(c)    for a certain period of time that we advise you in advance, up to a maximum of four hours (“Event”).

2.2.    You’re under no obligation to participate in an Event.

2.3.    Your expected energy usage is calculated by taking your average usage over your previous 10 days at the same time as the Event and multiplying it by a weather correction factor (“Expected Usage”). If you participate in an Event, we’ll determine at our absolute discretion the weather correction factor and whether you’re eligible for a credit and let you know. If the Event is on a weekday, the expected usage is calculated by averaging consumption over the previous 10 weekdays.

2.4.    If you are a non-solar smart meter electricity customer, you respond Yes to the Event Confirmation SMS at least 30 mins prior to the Event Start to confirm your participation in each Event and you: 
(a)    reduce your electricity usage to less than your Expected Usage during an Event, we’ll reward you with a $5 (including GST) credit on your next electricity bill after the Event; or
(b)    reduce your electricity usage by at least 30% less than your Expected Usage during an Event, we’ll reward you with a $10 (including GST) credit on your next electricity bill after the Event.
 
2.5.    During the Trial you must:
(a)    grant us access to and the right to use the data recorded by the Powerpal Device for the purposes of the Powerpal Program; 
(b)    not interfere with or override in any way the activities set out in this Agreement (including, without limitation, by using a third party software applications and tools to modify or alter any settings and features of the Powerpal Device); and
(c)    let us know if you notice that the Powerpal Device isn’t working.

3. Ending your participation in the Powerpal Program

3.1.    If you no longer want to participate in the Powerpal Program you can let us know by clicking the unsubscribe button in the event notification.
3.2.    We may end the Powerpal Program at any time by letting you know.

4. Liability

4.1.    You’re solely responsible for deciding whether to reduce your electricity usage during an Event, including whether there is any potential impact to someone’s health or whether any appliances or devices will be impacted by reducing your electricity usage.
4.2.    To the extent permitted by law, we’ll not be liable to you for any damage, claim or loss arising directly or indirectly from your participation in the Powerpal Program or an Event, including, but not limited to, any indirect or consequential loss.
4.3.    We have the right to cancel an Event with minimum 1-hour notice.
